I. Scope
This privacy document governs how Mammut Group and its subsidiaries (“Mammut”, “we”, “us” or “our”) collect, use, store and disclose information collected from users (each, a “User” or “you”) of the mammut.com websites (the “Sites”), the Barryvox application and customers in the retail and online stores we operate, and the further processing of personal data by Mammut Group affiliates (collectively Mammut).
If you provide Mammut with personal data of other people, for example data concerning the recipient of a voucher, please only provide their personal data to Mammut if you are permitted to do so in accordance with applicable data protection laws and only if the other person would agree to you providing their personal data to Mammut for the purposes for which the data is collected and the processing of their personal data in accordance with our data privacy notice.
II. Controller
Each Mammut website, social media presence, multimedia portal, chatbot, and application (each being a website) has a designated person within Mammut responsible for the collection of personal data in accordance with the EU General Data Protection Regulation (GDPR) (or comparable provisions under applicable data protection laws). Unless otherwise stated on the website (according to the legal notice, terms of use, etc.), Mammut Sports Group AG, Birren 5, 5703 Seon, Switzerland, is the data controller for the online shops. www.mammut.com and the person responsible for the Mammut group's websites and the Barryvox application.
The respective subsidiary or affiliate is responsible in the event that Mammut communicates by other means of communication (such as email, letter, telephone, in person) and the communication does not fall within an activity for which Mammut has designated a specific responsible party in this data protection notice or otherwise.
If a Mammut company or affiliate discloses personal data to another Mammut company or affiliate for purposes specific to that company or affiliate, that company or affiliate is the data controller. Mammut has not appointed a data protection officer in accordance with Article 37 of the GDPR, except for the Mammut affiliate in Germany.

Customer personal data is generally collected directly by Mammut when using the website, in Mammut stores or at Mammut events, and through direct communication such as email, telephone, or other means. Personal data may also be collected indirectly, for example, by third-party subcontractors (e.g., Mammut's partners, as defined below, including wholesalers, resellers, retailers, suppliers, and other business partners such as customer service providers). Mammut also collects data when the customer making the purchase is not the intended recipient, or if the purchase is shipped to another person (e.g., as a gift), based on a third-party recommendation (e.g., a recommendation from the customer's family or friends), or through the acquisition of additional information from third-party data sources (e.g., social media). III. 1. Product Purchase and Order Fulfillment
We process your personal data to fulfill your online orders and offer you a range of secure payment options. This includes facilitating a smooth payment experience, ensuring that payment is made, and fulfilling our contractual obligations under our Terms and Conditions, such as issuing invoices, arranging delivery, and managing returns and refunds.
In order to achieve the objectives mentioned above, we process your personal information (first and last name) and your contact details: postal address; billing address; delivery address; email address, telephone number and details of your purchase.

On our website, there is an option to create your own Mammut account, which offers you various advantages and makes the Mammut site experience smoother (for example, saving your favorite products, having an overview of your purchase history, saving and managing your delivery address, providing you with personalized content).
If you decide to create a Mammut account, we will process your identity information, contact details, location information, payment, purchase and transaction information, social media interactions and activities, browsing information, as well as your behavioral and preference information.
You can still make purchases on our site as a guest, without creating an account.

III. 16. Barryvox Product Registration
If you purchase a Barryvox device (previous models, prior to Barryvox 2), you have the option to register your device on our website to receive important information about software updates and to benefit from a free three-year extension of your warranty.

III. 17. Barryvox Application
We provide a dedicated mobile app for our Barryvox devices. Once the app is downloaded, you can add and register your Barryvox device.
To register your device, you must create a Mammut account if you don't already have one. The registration link will take you to Mammut.com where you can create your Mammut account and then register your device.
We use your personal data solely for the following purposes: to provide you with the application's features and services, to communicate software updates or any information related to your registered device, to send you notifications in the event of a model being discontinued, and to identify whether your device is being used or activated in countries where the voice function cannot be used due to a court order. Regarding device registration, we use your personal data to offer you an additional 3-year warranty extension for your device, to communicate software updates or any information related to your registered device via email, to send you personalized marketing messages (if you have subscribed), product surveys, and to request feedback via email.
The following information is requested for account creation and device registration: email address, password, and device number. The following data is collected when using the application or if the application is running in the background: your geolocation each time you connect your device to activate the voice function, your IP address, crash data in case of application problems, and the country of the active store on the device.
Mammut may also receive and/or disclose your personal data, for specific purposes, to third parties, including the following:
- Voice function activation for Barryvox devices: an interaction and application design company
- User and device registration process: identity and access management providers
- Enabling Barryvox app features: push notification and crash reporting tool providers
- Identifying the location of Barryvox devices: analysis tool

- Sending you emails regarding the status of your account, including updates on rewards, benefits and gifts (in accordance with theGeneral terms and conditions of membership ), special events, offers, exclusive promotions, information on how you can earn points outside of your purchases, and managing maintenance requests. You can unsubscribe from these communications at any time by clicking the unsubscribe link in any email you receive from us.
- Save your delivery address to simplify the payment process on our website.
- Maintain a complete record of your order history for your continued access.

IV. Data Retention
As a general rule, Mammut retains personal data only for as long as necessary to fulfill the purposes for which it was collected. However, there are circumstances where personal data may be retained for longer periods, subject to the following conditions: Mammut will continue to process personal data if (i) this is required by contract, legal obligation or other applicable provisions, or (ii) it has an overriding legitimate interest—such as retaining data for evidentiary purposes in the event of legal claims, documenting compliance with legal or regulatory obligations, or conducting non-personalized data analysis.
Different retention rules may apply when data has been anonymized or pseudonymized, subject to applicable laws.

When third parties act as data processors, they are contractually obligated to process personal data only in accordance with Mammut's instructions and applicable legal requirements. However, some third parties—such as logistics providers and event management platforms—operate as independent data controllers. This means they determine the purposes and methods of processing your personal data independently of Mammut.
VI. Transfers outside the EEA
Any transfer of personal data to Mammut employees, our affiliated companies or third parties located outside the European Economic Area (which includes all EU Member States, as well as Iceland, Liechtenstein and Norway) is carried out in accordance with the EU Standard Contractual Clauses to ensure an adequate level of data protection.

Users may encounter advertisements or other content on the Site that link to websites or services provided by Mammut's partners, suppliers, advertisers, sponsors, licensees, social media platforms, and other third parties. VIII. Your right to refuse
